Which source text is used?

Unless advised otherwise, Direct Validation always uses the source text stated in the Decision to Grant. This is almost always the text intended for grant. Use of the B-document is not advisable as this has no legal status.

Does it make any difference if the source text is in German or French?

No, this makes no difference in terms of quality. In each country Direct Validation has translators that can translate from any of the three official source languages (English, French and German).

Quotes & Orders

What you see is what you pay.
When using Direct Quote  or placing a Direct Order , all necessary costs for the validations are included from the beginning, such as translation and official fees. There are two ways: If you are not registered you can simply click the Place a Direct Order button at the start page and follow the instruction. If you have already registered, just log in and click the Place a Direct Order button from there.

You can order:

  • Validations of granted European patent applications.
  • Validations and translations of the patent claims, i.e. the sort of translations you are asked to perform at the stage called Intention to Grant according to rule 71(3).
  • Just the translations of the patent claims.

Yes of course! On the first page of registration of your order you will find an option called “Include 71(3) translations?” This is found just to the right of EP application date.

After getting a quote or placing an order you will see the status Pending Quote or Pending Order. Within 2 business days Direct Validation will send you a firm quote/accept the order as firm.

In case of an order you will also receive the invoice and, if necessary, the Powers of Attorney and similar documents to be signed.

Please note that at any time, Direct Validation can decline a placed order if it is considered that the time is too short, for example due to a very long translation.

It is valid for 30 days or until the end of the 3 month validation period.

  • Pending Quote: When you get a Direct quote on the screen.
  • Quote: 2 business days after asking for the quote you will get a firm quote from Direct Validation.
  • Expired Quote: A quote older than 30 days.
  • Pending Order: When you see the result on your screen after having placed a Direct Order.
  • Accepted Order*: 2 business days after having put a Direct Order, you will have the order confirmed by Direct Validation.
  • Expired Validation Period: The 3 month validation period has expired.
  • Validated: The validation process is finished.
  • Delivered 71(3): The Intention to Grant 71(3) job is finished.

Please note that at any time, Direct Validation can decline a placed order if it is considered that the time is too short, for example due to a very long translation.

The number of countries depends on the EP application date and also on if you have limited yourself in the number of designated countries at the time of the EP application.

No problem, just start a new order and inform Direct Validation that it is connected to the first order.

No, Direct Validation means “Validations directly without middlemen”. In a few countries, however, it is still mandatory to use a local agent.

Yes, just tell Direct Validation who you want to use and in which country. Please note that Direct Validation charges €150 per country and the prices of the local agent are applied.

In general no but a few countries like Austria, Switzerland and Italy have specific laws demanding that one has to have an address in the country. For those countries Direct Validation has a local address free of charge for you.

Price & Invoice

On the screen:
Everything is included in the price you can see on the screen. The only exception would be if there was text in drawings or a lot of graphics in the description.

In the emailed Quote or Accepted order you receive two office days later from Direct Validation:

If you are a patent holder, there is nothing you or Direct Validation needs to do in countries like the UK, France, Germany, Luxembourg and Liechtenstein. The respective patent office performs an automatic validation of your patent on the first day of the 3 month validation period (the Date of Grant).

Some patent attorneys want to hand over the validation to other patent agents or attorneys in these countries but it is not necessary and only means extra costs for you.

Two office days after you have asked for a Direct Quote or placed a Direct Order at www.directvalidation.com you will receive a firm quote/accepted order.

To begin with, the price is always based on the number of words in the source text, not in the translations.

If you ask for a Direct Quote and have marked that you know the number of pages in your patent text, the price you see on the screen is based on the following standard pages:

  • Description: 300 words/page
  • Claims: 200 word/page
In the accepted quote you receive two office days later by email, the correct numbers of words are used for the price calculations.

The invoice will arrive by email together with the accepted order, two office days after you have placed your order.

No, it does not matter.

Direct Validation’s late order surcharges are as follows:

  • 10% if ordered 17 to 21 days before the due date.
  • 20% if ordered 12 to 16 days before the due date.
  • 30% if ordered 8 to 11 days before the due date.
  • 50% if ordered less than 8 days before the due date (in such cases we cannot guarantee that all cases will be filed on time).

At any time, Direct Validation can decline a placed order if it is considered that the time is too short, for example due to a very long translation.

Due date means the last day of the 3 month validation period (4 month period for the 71(3) cases), “days” mean calendar days. The surcharges are normally displayed in the accepted order email you will receive two office days after you have placed your order, but not on the screen when placing the order.

  • All cancellations must be made in writing and accepted in writing.
  • Translations which have not been started and official fees that have not been paid, will be fully reimbursed. Bank fees will be paid by the customer.
  • Direct Validation’s service fees (Submission/filing fees) will be limited to 50% for each country in which the case has not yet been submitted.

Power of Attorneys

Why have I received forms to sign if Direct Validation does not use local attorneys?

Some patent offices require the use of certain forms. As Direct Validation hands in your cases directly to the national patent offices we need the signed forms to be able to conclude the validations.

When do I receive the forms and Powers of Attorney?

Two office days after you have placed your order, the forms, if any, will arrive by email together with the accepted order.

How do I know what is said in the foreign forms?

If you are in any doubt, please contact Direct Validation.

Can I send the signed Power of Attorney to Direct Validation at a later stage, or even after the end of the 3 month period?

In most countries it is possible to file the Power of Attorney after the end of the 3 month period but not in all. If Direct Validation needs to send in the signed Power of Attorney separately, extra charge of 80 Euro will be added.

What are annuities?

Annuities, also called annual fees or renewal fees, are fees paid every year to keep the patent or patent application alive.

Can Direct Validation administer payment of annuities?
